Terms of Service

These terms govern your use of Big 2 (bigtwo.online). By using the site you agree to them. If you don't agree, please don't use the service.

1. Acceptance of terms

By accessing bigtwo.online or creating an account, you agree to be bound by these Terms of Service and the Privacy Policy. If you are using the service on behalf of a company or other organisation, you represent that you have authority to bind that organisation to these terms.

These terms form a binding agreement between you and BigTwo.online.

2. Eligibility

You must be at least 13 years old to create an account. If you are between 13 and the age of digital consent in your country (16 in some EU countries), you may need a parent or guardian's permission. By creating an account you confirm that you meet these requirements.

You may not use Big 2 if you are barred from doing so under applicable law, or if your account has previously been terminated for breach of these terms.

3. Your account

You are responsible for keeping your account credentials safe — your email inbox (for magic-link sign-in) and your linked OAuth providers (Google, Discord). Do not share access to your account.

You are responsible for activity that happens under your account. Notify us at [email protected] if you suspect unauthorised access.

You may delete your account at any time from your profile. Deletion is permanent and cannot be undone, except for any minimal records we are required by law to retain (see the Privacy Policy).

4. Acceptable use

When using Big 2 you agree not to:

Cheat, exploit bugs, use automated tools or bots in multiplayer games, or otherwise undermine the fairness of play for other players.

Harass, threaten, defame, or impersonate other players. Choose a display name that is not abusive, slurred, or misleading.

Scrape, mass-download, or programmatically scan the service except as expressly permitted by our robots.txt or with our written consent.

Use the service for any unlawful purpose, including the distribution of malware, copyrighted content you do not own, or content that violates the law of your jurisdiction.

We may suspend or terminate accounts that breach these rules, with or without notice depending on the severity.

5. Content you provide

The display name you choose is the main piece of content you provide. You retain whatever rights you have in it, but you grant us a worldwide, royalty-free licence to display it within Big 2 (for example to other players in a room, or on leaderboards if we add them).

You agree not to choose a display name that infringes someone else's trademark, that impersonates a real person, or that is otherwise unlawful. We may rename or remove offending display names at our discretion.

6. Purchases (when available)

Big 2 is free to play. We may offer optional cosmetic items (such as card-back skins) for purchase in the future. These items are virtual goods, do not affect gameplay outcomes, and have no real-world monetary value.

Purchases will be processed by a third-party payment processor (currently planned: Stripe). When you make a purchase, you agree to that processor's terms in addition to ours. We do not store your full payment-card details on our servers.

All prices are in US dollars unless stated otherwise. Applicable taxes (such as VAT or sales tax) may be added at checkout.

7. Refunds and digital goods

Because cosmetic items are digital goods delivered immediately, we generally do not offer refunds once an item has been redeemed and applied to your account. EU consumers may have a 14-day right of withdrawal under the Consumer Rights Directive, but you waive this right when you redeem the item immediately at checkout — we will explicitly ask you to confirm this waiver before processing the purchase.

We will issue refunds where required by law, where a purchase failed due to a bug on our side, or at our discretion in clear cases of mistaken purchase made within 24 hours and not yet redeemed.

8. Intellectual property

All site code, artwork, sounds, and other materials we provide are owned by BigTwo.online or licensed from third parties and are protected by copyright. You may not copy, modify, distribute, or reverse engineer the service except as permitted by law (for example, the right to make a personal backup of software you have lawfully obtained).

Big 2 is a card game in the public domain, and the names 'Big 2', '大老二', 'Tiến Lên', 'Pusoy Dos', and similar are descriptive of the underlying game. Nothing in these terms claims ownership of those generic terms.

9. Third-party services

Big 2 integrates with third-party services (Google, Discord, Supabase, Netlify, Cloudflare, Ko-fi, Stripe in future). Your use of those services is governed by their own terms. We are not responsible for the actions, content, or policies of third parties.

10. Suspension and termination

We may suspend or terminate your access to Big 2, with or without notice, if you breach these terms, if your account is being used abusively, or if we are required to do so by law.

You may stop using the service at any time and may delete your account from your profile. Sections of these terms that by their nature should survive termination (for example, intellectual property, disclaimer of warranties, limitation of liability, governing law) will continue to apply after termination.

11. Disclaimer of warranties

Big 2 is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that any specific feature will be preserved over time. Some jurisdictions do not allow disclaimers of implied warranties; in those jurisdictions, the disclaimers above apply only to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, BigTwo.online will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of Big 2. Our total aggregate liability for any claim arising from or related to these terms or the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) US$20. Some jurisdictions do not allow limitations on certain types of liability (such as for gross negligence, fraud, or death and personal injury); these limitations do not apply to such liability.

13. Indemnity

You agree to indemnify and hold harmless BigTwo.online from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these terms, your violation of any law or third-party right, or your misuse of the service.

14. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. To the extent not prohibited by your local consumer-protection law, you agree that any dispute arising from these terms or the service will be brought in the state or federal courts located in California, and you consent to personal jurisdiction there. Nothing in this section deprives you of mandatory consumer-protection rights you have under the law of your country of residence.

15. Changes to these terms

We may update these terms as the service evolves. When we make material changes, we will update the 'Last updated' date at the top of this page and, for substantial changes, notify you in-app or by email at least 14 days before the change takes effect. Your continued use of the service after a change takes effect means you accept the updated terms.
